Terms of Service

1. Acceptance of terms

By accessing or using Graphito (“the Service”), operated by Graphito (“we”, “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of the Service

Graphito is a documentation-as-a-graph platform that provides AI agents with structured project context, persistent memory, task management, and code review capabilities through the Model Context Protocol (MCP).

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and API keys. Notify us immediately if you suspect unauthorized access.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse-engineer, decompile, or disassemble any aspect of the Service.
• Use the Service to store or transmit malicious code.

5. Your content

You retain ownership of all data you upload or generate through the Service, including repository metadata, documentation, and agent memories. We do not claim intellectual property rights over your content.

You grant us a limited license to process, store, and display your content solely to provide the Service. This license terminates when you delete your content or account.

6. Subscriptions and billing

Paid plans are billed monthly or annually through our payment processor (Polar). All fees are non-refundable unless required by law. We may change pricing with 30 days’ notice.

Free trials do not require a credit card. At the end of a trial, your account will be downgraded unless you subscribe to a paid plan.

7. Service availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.

8. Limitation of liability

To the maximum extent permitted by law, Graphito shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Termination

Either party may terminate this agreement at any time. You can delete your account from the dashboard settings. We may suspend or terminate your access if you violate these terms, with notice when reasonably possible.

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

10. Changes to these terms

We may modify these terms at any time. Material changes will be communicated via email or an in-app notice at least 30 days before they take effect. Continued use after changes constitutes acceptance.

11. Governing law

These terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Madrid, Spain.
